Description of Service

Imgfy is an AI-powered image generation and editing platform operated by MOONLIGHT LABS PTY LTD that allows users to:

• Generate images from text descriptions
• Edit and modify existing images using AI
• Remove objects or backgrounds from images
• Apply AI-powered image transformations
• And other AI-powered image creation features

Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, complete, and up-to-date information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@imgfy.io if you suspect any unauthorised use of your account.

Fees and Payment

Acceptable Use Policy

You agree not to use the Service to:

• Generate or distribute content that is illegal, harmful, abusive, defamatory, or obscene
• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Impersonate others without their permission
• Attempt to reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems, bots, or scrapers to access the Service without our express written permission

Intellectual Property

Content Generation Guidelines

• Your text prompts and instructions are lawful and do not violate these Terms

Service Limitations

• The Service will be uninterrupted, timely, or error-free
• The quality of generated images will meet your expectations

Termination

Either party may terminate your use of the Service.

• You may terminate your account at any time by contacting us at support@imgfy.io; your right to access the Service will cease immediately upon termination
• MOONLIGHT LABS PTY LTD may suspend or terminate your account at any time, with or without notice, for any reason including but not limited to your violation of these Terms
• Upon termination, all licences granted to you under these Terms will immediately terminate and you must cease all use of the Service
• Provisions that by their nature should survive termination — including intellectual property rights, indemnification, and limitation of liability — will continue to apply

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

Disclaimers and Limitation of Liability

• Our total liability to you for any claim arising out of or relating to these Terms or the Service is limited to the total amount you paid us in the 12 months preceding the claim

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to conflict of law principles. You irrevocably submit to the exclusive jurisdiction of the courts of Victoria, Australia for any dispute arising under or in connection with these Terms.
